1. Introduction
- These Terms of Service ("Terms") govern your use of Gentle Ally, operated by Rinavore Limited, an Irish limited company ("we", "us", "our"), including our iOS app and website at gentleally.com (collectively, the "Service").
- Gentle Ally is a caregiver assistant app that helps transform direct demands into declarative, choice-oriented language for supporting children with Pathological Demand Avoidance (PDA).
- By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. Account Terms
- You must be at least 18 years old to create an account and use the Service.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activities that occur under your account.
- You must provide accurate and complete information when creating your account.
- You may not use the Service for any illegal purpose or in violation of any laws.
3. Acceptable Use
- Use the Service only for its intended purpose: supporting caregivers in communicating with children using PDA-aware strategies.
- Do not attempt to interfere with, disrupt, or damage the Service or its servers.
- Do not attempt to access other users' accounts or data.
- Do not use the Service to generate content that is harmful, abusive, or inappropriate.
- Do not resell, redistribute, or commercialise the Service without written permission.
4. Subscription & Payments
- Gentle Ally offers subscription plans with a 7-day free trial.
- Subscriptions are billed through Apple's App Store and are subject to Apple's terms and payment policies.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your Apple ID account settings.
- Refunds are handled by Apple according to their refund policies.
- We reserve the right to change subscription pricing with reasonable notice.
5. Intellectual Property
- The Service, including its design, features, and content, is owned by Gentle Ally and protected by intellectual property laws.
- You retain ownership of the content you create (e.g., child profiles, translation inputs).
- By using the Service, you grant us a limited licence to use your content solely to provide and improve the Service.
- We do not claim ownership of your content, and we do not sell your data to third parties.
6. AI-Generated Content Disclaimer
Important: Gentle Ally is not a substitute for professional medical, therapeutic, or psychological advice.
- The translations and suggestions provided by Gentle Ally are generated by artificial intelligence.
- AI-generated content is intended as a supportive tool, not as professional guidance.
- Always use your own judgement when communicating with your child.
- If your child is experiencing a mental health crisis, please contact a qualified professional or emergency services.
- We do not guarantee that AI-generated suggestions will be appropriate for every situation.
7. User Content & Data
- You control the data you enter into the Service (child profiles, translations, conversations).
- Your data is processed by AI services to generate suggestions. See our Privacy Policy for details.
- We do not sell your personal data or use it to train AI models beyond providing the Service to you.
- You can request deletion of your account and data at any time through the app's Settings.
8. Limitation of Liability
- The Service is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee that the Service will be error-free, uninterrupted, or meet your specific requirements.
- To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claims arising from your use of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.
9. Indemnification
- You agree to indemnify and hold harmless Gentle Ally from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Termination
- You may cancel your account at any time through the app's Settings.
- We may suspend or terminate your account if you violate these Terms.
- Upon termination, your right to use the Service will cease immediately.
- You can request deletion of your data upon account termination.
11. Changes to Terms
- We may update these Terms from time to time to reflect changes in our Service or legal requirements.
- We will notify you of material changes through the app or via email.
- Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
- These Terms are governed by the laws of Ireland, without regard to conflict of law principles.
- Any disputes arising from these Terms will be resolved in the courts of Ireland.
